1. 1. Definitions

"Abiria" refers to Abiria Limited, a private chauffeur and car rental service operating in Nairobi, Kenya. "Client" refers to any individual or organisation that books or uses our services. "Service" refers to all chauffeur, transportation, and related services provided by Abiria. "Vehicle" refers to any car in the Abiria fleet assigned to fulfil a booking.

2. 2. Booking Terms

All bookings are subject to vehicle availability and must be confirmed by Abiria. A booking is considered confirmed once the client receives a confirmation email or message with a booking reference number. Abiria reserves the right to decline or cancel bookings at its discretion, including in cases of safety concerns or misuse.

3. 3. Payment

Payment terms vary depending on the service type and payment method selected. Accepted methods include M-Pesa, credit/debit cards, and cash on pickup. Full payment or a deposit may be required at the time of booking. Failure to make payment may result in cancellation of the booking. All prices are quoted in Kenyan Shillings (KES) unless otherwise stated.

4. 4. Cancellation & Refunds

Cancellations made more than 24 hours before the scheduled pickup receive a full refund. Cancellations between 12 and 24 hours incur a 50% charge. Cancellations within 12 hours of pickup are charged in full. Please see our Cancellation Policy page for complete details.

5. 5. Limitation of Liability

Abiria shall not be liable for delays or inability to perform services due to circumstances beyond our control, including but not limited to traffic conditions, road closures, weather events, or government directives. Our liability for any claim arising from our services shall not exceed the total amount paid for the specific booking in question.

Abiria is not responsible for personal items left in vehicles, though we will make reasonable efforts to recover and return lost property.

6. 6. Intellectual Property

All content on the Abiria website, including text, graphics, logos, images, and software, is the property of Abiria Limited and is protected by Kenyan and international copyright laws. You may not reproduce, distribute, or create derivative works from any content without our express written permission.

7. 7. Governing Law

These terms shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of Kenya.
